TERMS AND CONDITIONS FUNKY STUFF DESIGN

Article 1. Applicability

1.1 The terms and conditions apply to all products found on the website and in the shop of Funky Stuff Design.

1.2 When ordering, you agree to the terms and conditions of Funky Stuff Design.

1.3 Funky Stuff Design is not responsible for any (interim) price changes. Any typos in the system does not guarantee delivery of products.

Article 2. Creation (and termination) of the contract

2.1 An agreement with Funky Stuff Design via the website, is created when an order confirmation e-mail has been sent to the customers specified e-mail address.

2.2 If the customer is not satisfied with the products, this must be reported immediately and to be returned in consultation with Funky Stuff Design, except by orders of custum made goods (see: Article 6 return).

Article 3. Prices, products

3.1 All prices on Funky Stuff Design are in euros, including 19% VAT and excluding shipping.

3.2 Products are available while stocks last.

3.3 Products shall remain the property of Funky Stuff Design, untill payment of that same product is received by Funky Stuff Design.

3.4 For custom made products, we ask for an advance payment of 25% of the sale amount.

3.5 Products can be reserved for up to seven days. After these seven days of reservation we put the article back in the shop.

3.6 We only sell original items. Given the age of these items, they can show signs of use.

3.7 We sell our lightning exclusive light bulbs.

Article 4. Payment

- Send: iDeal, Bank transfer or PayPal

4.2 Delivery is on the account of the customer. Furniture and extremely fragile products must be picked up in Haarlem, or can be delivered. Shipping by post of extremely fragile products occurs only on demand of the purchaser and under responsibility of the purchaser.

4.3 Payment of an order by transfer should occur within 7 days. If payment isn’t made within the deadline, Funky Stuff Design will cancel the order.

4.4 Funky Stuff Design reserves the right to bring the items ordered, back in sales, in case of absence of payment within the deadline of 7 days.

Article 5. Delivery and deliveryperiod

5.1 Orders are shipped as soon as possible. Funky Stuff Design strives to deliver the order within 3 business days after receipt of payment. Except the custom-made lampshades, cushions and wall decorations of retro fabric, witch have a deliveryperiod of 2 or 3 weeks after receipt of (down) payment.

5.2 Once the ordered articles are picked up or shipped, the transportation risk passes to the customer.

5.3 In case of delivery by Funky Stuff Design, the ordered products are delivered to the frontdoor on ground level. The customer must take care of the transport within the home.

Article 6. Returns

6.1 A purchase may be returned up to seven days after purchase, if packaging and product are in the same state as when Funky Stuff Design sent or transferred the product to the customer. Any costs, made for sending to the customer and / or the return of items, is borne by the buyer.

6.2 Custom made products such as cushions of custom sizes and custom lampshades, can not be canceled or returned after payment.

Article 7. Warranty

7.1 Funky Stuff Design is not liable for loss or damage of items during shipment. If desired, buyer can insure the shipment wherefore payment of additional costs is required.

7.2 The customer shall at all times be aware of the age of the products purchased. This in mind, Funky Stuff Design can not be held responsible for defects that shows up after purchase.

7.3 If any damage to the products in the shop, as well on the website is known by Funky Stuff Design, they are required to inform the customer about it.

7.4 The customer is responsible for the proper use of purchased items, and therefore can not claim warranty if used incorrectly. This includes maintenance and washing instructions which, if desired, by Funky Stuff Design are provided.

Article 8 Liability

8.1 Funky Stuff Design is not liable for any damage to movable or immovable property and for injury to or death of persons resulting from use of products supplied by Funky Stuff Design.

8.2 Buyer assumed to be known, when purchasing vintage products, that products manufactured at different times when demands were made on safety and regulations and use which may not comply with current legislation. Electronic devices are tested by us and sold only if they are working. However, we can given the age of our products (often decades old), give no technical guarantee.

8.3 Buyer shall at all times be responsible for compliance, and ensure safe and responsible use of products purchased at Funky Stuff Design.

8.4 Funky Stuff Design is never required to pay damages to the client unless there is intent or gross negligence on the part of Funky Stuff Design.

8.5 If, for any reason at all, Funky Stuff Design is due to pay for any damages, it will never exceed the amount of the invoice value to the product.

Article 9. Privacy statement

9.1 Your personal data will not be shared with partners or third parties. This is consistent with the Dutch law of Privacy information.
